Isnt this child abuse?

Hey Everyone I have a question, Hopefully this is the right place to put this thread. I have a niece who is thirteen years old. This morning her mom dropped her off at my house and said that her father was hitting her. Apparently what happened is that he punched her in her face, busted her lip and also caused some marks on her leg. Her mom woke up in time and was able to stop him. What hurts me is that her grandmother was there and didnt try to stop this. Now, the father ran off to the policestation filing a report saying the dauthter was rude--(she spoke back to him) at that same time the mother came in to file the report and can you believe the police took the fathers side? I dont even think they filed her mom's report at all. I believe in spanking of a child at a certain age, but come on the father physically hit her like a man. I mean isnt this abuse? When the child tried to say what happened the police told her not to talk. I thought we all had rights. What is everyone's take on this? Any tips or hints on what can be done? Btw, this isnt the first time he has hit this child or his other 2 daughers.

I'd say to make a case. Quickly. If she has the marks, thats definately important. Take pictures if possible. Spanking is okay, but hitting a child to make them bleed is just wrong. If he has a history of this, I'm sure you could go to a judge over it.
